General terms and conditions of sale

ARTICLE 1 - PREAMBLE

1.1 Purpose

The present General Terms and Conditions of Sale specify the rights and obligations of the customer with regard to the products sold in the electronic catalogue of the website www.augustine-paris.com as part of a distance selling system.

The contract, drawn up in the event of an effective order, comes under the regulations of distance selling, as it results in particular from the Consumer Code, as well as the specific provisions mentioned below.

The order implies irrevocable adherence to the General Terms and Conditions of Sale. The customer declares to have the capacity to conclude the present contract, i.e. to be of legal majority and not to be under guardianship or curatorship.

Acceptance without reservation of these General Terms and Conditions of Sale will consist in the fact that the customer ticks the box "I accept the General Terms and Conditions of Sale". The fact of ticking this box will be deemed to have the same value as a handwritten signature on the part of the customer.

ARTICLE 2 - CONTRACT

2.1 Operation

After placing your order, we will send you an e-mail confirming your order.

You can follow the progress of the processing of your order by sending an email to AUGUSTINE PARIS customer service:iinfo@augustine-paris.fr. If the order has been sent, AUGUSTINE PARIS will provide the customer with a parcel tracking number. The customer will then be able to track the shipment by visiting the websites made available by the carriers (La Poste Colissimo, UPS, Fedex).

2.2 Changing / cancelling an order

 In case of error concerning the elements of the order (address, size...), the Customer has the possibility of modifying or cancelling it before its treatment and expedition by our care. For this, please contact us by email: info@augustine-paris.fr.

2.3 Packaging

Each piece of jewellery purchased is carefully packed, depending on the model, in a pouch and tissue paper or in a box and tissue paper. It is accompanied by a certificate of authenticity signed by the brand, as well as its purchase invoice.

 

ARTICLE 3 - AVAILABILITY, DELIVERY, PRICES

3.1 Availability and delivery

AUGUSTINE PARIS creations are made by our qualified craftsmen in Paris. Any order of a product in stock is processed within 48 hours (excluding weekends and holidays), following receipt of payment. If the item is not in stock, it is shipped within 1 to 3 weeks, depending on the availability of the workshop.

If, despite our efforts, a product could not be delivered, we will inform you by e-mail and/or telephone as soon as possible and your order will be cancelled, without this giving rise to any compensation other than a refund of the order.

In case of non-delivery due to a wrong address given by the customer, or any other cause due to the customer (absence of name on the mailbox, lack of information ...) the return of the package will be reorganized, at the expense of the customer.

3.2 Special Orders

The so-called "special" orders refer to the custom-made realization of a piece of jewellery. Any buyer wishing to make a special order is invited to contact our customer service department in order to find out the feasibility of his request, to receive a quote and to be informed of the shipping delays. 

3.3 Prices

The prices of the products are those indicated on the site whatever the place of delivery and include all French taxes (TTC), excluding delivery costs, which are the responsibility of the customer.

Additional taxes (import sales tax, customs duty or handling charges) may be applied by the customs office of the country concerned and are your responsibility. The beneficiary of the package will then be invoiced by the carrier. By placing an order on our site, you accept the rules for importing goods; please note that import rules vary from country to country. These taxes cannot be refunded in case of return or exchange.

We reserve the right to change our prices without notice and at any time. Products already ordered will be invoiced according to the prices at the time of registration of your order. 

3.4 Delivery time and costs

The site delivers worldwide. The ordered product is delivered to the address shown on the customer's order form, with the exception of the "Withdrawal in showroom" option. The delivery address may differ from the billing address.

The delivery time depends on the delivery address as well as on the means of delivery selected by the customer. The company shall not be held responsible for any delay related to the customs clearance of the exported goods.

The delivery times specified below are only valid from the date of dispatch of the order.

Delivery in France is made, at the customer's initiative, by one of the following transport options:

  • French Post (Colissimo with delivery against signature) : Delivery within 1 to 3 working days after dispatch.

  • UPS or FEDEX: Delivery within 1 to 3 working days after shipment

  • Pick-up at the showroom: Delivery to the showroom within 48 hours for all orders placed before 3pm (French time), working day and by appointment.

International deliveries (outside of metropolitan France, Monaco and Andorra) must be made by the carrier UPS or FEDEX.

Delivery costs are free for France (standard delivery), and 500€ outside France.

In case of damage, the customer expresses his reserves precisely and clearly on the delivery note, a copy of which is sent by La Poste or by the carrier to the company. In this respect, it is the customer's responsibility to check the content, conformity and condition of the product upon delivery. This verification is deemed to have been carried out as soon as the customer, or a person duly authorized by it, has signed the delivery note presented by the recipient of La Poste or by the carrier.

ARTICLE 3 - PAYMENT

4.1 Terms of payment

You can pay by credit cards (CB, Visa, Mastercard, American Express, Apple Pay) or via Paypal.

Payments by cheque or money order are not accepted.

4.2 Validity of the order 

In accordance with the provisions of Article L 132-2 of the Monetary and Financial Code, the commitment to pay by payment card is irrevocable. By communicating his credit card number and the above-mentioned information, the Customer authorises the company to debit his credit card for the total amount including tax of his order (delivery charges included).

To this end, the customer confirms that he is the holder of the bank card to be debited and that the name appearing on the bank card to be debited is indeed his own, and then communicates in a secure environment on the site of our payment partner, the sixteen-digit number and expiry date appearing on the front of his bank card, as well as, where applicable, the numbers of the visual cryptogram appearing on the back of his bank card.

In order to bring an additional security to the online payment by credit card, this payment will benefit from the 3D secure program. This program aims to fight against fraud by asking the Internet user who wishes to make a payment on the Internet to identify himself when paying by credit card on the e-merchant's website. During the transaction, the cardholder is directed to a page of his bank and enters data that the bank can verify. This security is materialized by the presence of the logos "Verified by VISA" or "MasterCard SecureCode".

4.3 Refusal of payment and cancellation of order

 For security reasons, we reserve the right to refuse payments and thus to cancel orders:
- For an unreferenced delivery address
- If we are unable to contact the person who placed the order
- For any doubt about the merits of the order

 

ARTICLE 5 - RETENTION OF TITLE

The delivered goods shall remain the property of the Seller until you take physical possession of the delivered product once the Customer has paid the price.

 

ARTICLE 6 - RETURN POLICY

6.1 Time limit and return address

In accordance with articles L 121-20 et seq. of the French Consumer Code, the customer benefits from a cooling-off period of fourteen (14) clear days from the date of delivery to reconsider his decision and return the item ordered without having to justify his reasons or pay any penalties.

The customer must notify his decision to withdraw within 14 days after receipt of his invoice, by contacting us by email at info@augustine-paris.fr.

The return should be made to the following address: AUGUSTINE PARIS, 88 boulevard du Général Giraud - 94100 Saint-Maur-des-Fossés. Attention, from this day, you have one week to return your parts. After this period, your return parcel will unfortunately no longer be taken into account and will be sent to you again. 

You also have the possibility of returning your parts directly to the AUGUSTINE PARIS showroom, within the time limit. 

6.2 Applicable fees

If you wish to return an item, AUGUSTINE PARIS will reimburse you for the payments received and, in the event of a return of a global order only (all the products ordered in a single order), the delivery charges. In the event of a partial return, delivery charges will not be refunded. Refunded delivery charges will be refunded on the basis of the standard (most economical) delivery method. If the customer has chosen another delivery method than the standard delivery method, the additional costs charged will not be refunded.

Return shipping is free for France only.

Customs charges may apply and are at the customer's expense for reception in non-EU countries and French overseas departments and territories.

If the return is due to an error on our part, the return costs paid by the customer will be refunded.

6.3 Product Compliance

The product must be in perfect condition, with its original packaging and purchase invoice. Items returned that do not conform or are unsuitable for resale, i.e. that are subject to modification, misuse (shock for example), neglect of maintenance (see our care tips), or normal wear and tear of the item by the customer will not be refunded, and the part will be returned to you.

In accordance with the provisions of article L121-21-8 of the French Consumer Code, products corresponding to special orders (custom-made) cannot be exchanged or refunded.

The risk of return is always borne by the customer. The customer is therefore strongly encouraged to return the package by any means that provides proof of its sending and gives it a certain date (registered mail with acknowledgement of receipt, colissimo suivi, etc.). Otherwise, AUGUSTINE PARIS will not be able to process your return.

6.4 Repayment period

Upon receipt of the package, we will verify the integrity of the items before accepting your return and requesting a refund. The refund will be made within fourteen (14) days, directly to the card used for the original purchase, in the same currency. We will send you a confirmation email as soon as we have made the refund request. 

For any exchange (product in another size or other stone(s)), we advise you to reorder, and send an email to info@augustine-paris.fr to be refunded the shipping cost of the second order.  

For any other information, complaint or question relating to the conditions of mail order sales set up by the company, customers should send an e-mail to the following address: info@augustine-paris.fr, recalling in both cases the reference and date of the order.

ARTICLE 7 - WARRANTY

All the products benefit from the legal regime of the guarantee of conformity provided for in articles L217-4 and following of the Consumer Code.

By virtue of this guarantee, when the legal conditions are met, the customer has a period of two (2) years from receipt of the product to request its repair or replacement subject to the cost conditions provided for in Article L217-9 of the French Consumer Code. The customer is exempt from providing proof of the existence of the lack of conformity during the six (6) months following delivery of the goods.

The products also benefit from the legal regime of the guarantee against hidden defects within the meaning of article 1641 and following of the Civil Code.

Under this warranty, the customer can choose between rescinding the sale or reducing the price of the product.

Are thus excluded from guarantee: articles subject to modification, misuse (shock for example), negligence of care (see our care tips), or normal wear and tear of the article by the customer.

ARTICLE 8 - CONFIDENTIALITY AND PERSONAL DATA

GRIPT SARL manages an electronic file which records certain personal data relating to its customers. When an order is placed on the Website by a new customer, this database is enriched with information concerning the customer, which will subsequently enable GRIPT SARL to better meet their expectations and facilitate the assistance services provided by the Customer Service department.

In the event that the client consents to the communication of individual personal data, he or she will have the individual right of access, withdrawal and rectification provided for by law and may in this respect have any information concerning him or her that is no longer relevant deleted by sending a request either in writing to GRIPT SARL or by e-mail to the following address: info@augustine-paris.fr.

ARTICLE 9 - LIABILITY

The Seller undertakes to describe with the utmost accuracy or to present a photograph of the Products sold on the Site, it being understood that the photographs represented on the Site are not contractual.

The Customer acknowledges and accepts that the prices of the Products are likely to vary between the Site and the retail stores, and that under no circumstances can this price difference be used as a basis for a request for total or partial reimbursement of the Products purchased either on the Site or in the stores.

In all cases, the responsibility of the Seller could not be engaged in the case where the non-performance of its obligations would be attributable either to the unforeseeable and insurmountable fact of a third party to the contract or to a case of force majeure as defined by French jurisprudence, or because of the consumer (Article L. 121-20-3 of the Consumer Code).

Likewise, the Vendor shall not be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses.

 

ARTICLE 10 - INTELLECTUAL PROPERTY

 The "AUGUSTINE" trademark, photos, logos, drawings and models appearing on the site are and will remain the exclusive property of the company. Any total or partial reproduction, without the express prior agreement of the company, is strictly forbidden in application of articles L 335-2 and L 335-3 of the intellectual property code and constitutes a counterfeit and an offence.

 

ARTICLE 11 - APPLICABLE LAW

These General Terms and Conditions of Sale and the commercial relationship between the company and the customer are governed by French law. Any dispute relating to the commercial relationship between the company and the customer shall be subject to the jurisdiction of the French courts.
